David Hicks Faces U.S. Military Tribunal

Suspect supporter of Tahliban and Al Qaeda who was captured in Afghanistan over 5 years ago as aiding Al Qaeda and the Tahliban faces a US Military Tribunal today US time.

He has been held in Gito Bay for 5 years on suspected terrorists activities without trial. In Australia his father has been activitly lobbying for David Hicks release or to face a trial on terrorists related crimes. Accusations of torture have surfaced in this time and abuses of David Hicks civil liberties, Including his physical and mental stability which is claimed has also been effected. Australian media has constantly protrayed David Hicks as a victim of the US being held in Gito Bay and quiet a few Australains believe David Hicks is innocent and must be released and have taken active support in the release of David Hicks.

I am not one of these people as I believe he has committed treason by joining Al Qaeda and the Tahliban and would have actively fired upon either Australian Troops just as he would have shot at US Troops. It is now claimed by the supporters of David Hicks that he will not receive a fair trial in the US even after these same supporters have lobbied that he receive a trial. In my opinion David Hicks will receive what is due to him and I believe he will receive a fair trial us under International Laws laid down and the US will afford him a fair trial. The news we are receiving at the moment is Hicks may go for a plea bargin to receive a lesser sentance before US Military Tribunal and consquent US Courts. I think the Americans can keep this bastard as I have no sympathy for him what so ever. He has tried to claim he was a British Subject under his mother's name and applied for British Passport which was rejected by the English Government.

He has also applied to human rights organisations about torture and abuse via his father in Australia. Up until last week his father was not going to the Trial as he feared he may prejudice his son's trial but now has changed his mind and has arrived in US to be at his son's trial as david Hicks faces Military Tribunal.

What annoys me is the arrogance of some Australians thinking we have some sort of say in the legal matters of another country and its laws. We do not have that right to interferr in the US Due Process of Laws or any other country due to the fact if some Australian is dumb enough to go and commit crimes in another country and is caught in the act of committing said crimes. I am not sympathetic for some idiot leaving Australia goes and commits crimes no matter what they are and then expect my Government to try and bail them out once they have been caught. This is just one case in regards to David Hicks.

Over last 15 years Australians have been caught drug trafficing in Indonesia Singapore Malaysia Philippines and Vietnam and have been dealt with accordingly. At the moment there are 10 high profile Australian cases in Bali Indonesia which carries the death sentance for some of these people caught. In 2006 in Singapore a drug smuggler was hanged at Changi Jail for attempting to smuggle herion into Australia via Singapore. He happened to be an Australian Citizen of Vietnamese Heritage. In Bali there are 2 seperate cases of 1 A woman Charpel Corby was caught smuggling drugs into Bali Airport from Sydney. 2 Nine people all Australians were caught trying to smuggle herion out of Bali to Australia. Several of these 9 smugglers face death under Indonesian Laws.

Some of my fellow country men and women believe the way countries other than Australia have barbaric laws and these must be changed. In my opinion they may have barberic laws but it is their laws and they have the right to have laws suited to their own country etc. It states quiet plainly under various immigration and tourism laws certain countries carry the death sentance for trafficing of drugs and I get tired of some bleeding hearts thinking Australians can go overseas and not face the music if they get caught in another country breaking laws of another country.

I'm with you Emac, I couldn't give a rats arse about this jerk. Anyone who is willing to pick up a weapon agains't his own country men deserves a bullet. I too, am sick of these bleeding hearts who support this terrorist, you can bet your balls if their son/daughter/husband was serving over there, they wouldn't be complaining about him being in jail. I've served in the region, so have my mates, and anyone willing to harm them will get NO sympathy from me.

As for the filthy drug smugglers, who cares, as long as they're looked up in some hell hole of a prison in Asia, there's a few less on our streets. Plus if your dumb enough to smuggle drugs into a country with the death penalty you deserve everything you get.

Got a guy like him in Phila that is getting a new sentencing phase of his trial for killing a cop. Name of Mumia Abdul Jammal. He is a cause celebre amongst the liberal set. Plenty of accusations of an unfair trial but none that stick. But you can never tell that to his supporters (Mike Farrel, Sting, ect).

Like this dude David Hicks, he is a lowlife. But to the lefties, that is impossible. It's all somebody else's fault.

David Hicks has appeared before Military Tribunal this morning and requested more lawyers onto his case. He was expected to enter a plea bargin today but didn't do so and made requests for extra legal team etc. But here is another aspect I saw Sean Penn on Fox News today making an arsehole of himself once again and disparging remarks about War in Iraq and War on Terror. Methinks we lock up the wrong insurgent supporters at times and send them to Hollywood to become 3rd rate actors with drug and alcohol problems

Further update David Hicks has done his plea bargin. Admitted to aiding a terrorist organisation in hope to get a lighter sentance and to serve it in an Australian Prison by end of this year. Media Legal Team and Terry Hicks are saying David pleaded guilty to escape Gitmo Bay and he is really innocent but pleaded guilty just to get home etc. They can say that but lets examine the other side of the story. The Proscution Legal Team had David Hicks balls in a sling and if he contested it and went to trial instead of copping a plea bargin. David Hicks would have spent years in a US Prison and would have been found guilty of proven evidence against him. In my opinion David Hicks copped the plea bargin to avoid some real hard time in a US Prison. I don't believe for one minute David Hicks is innocent of any charges against him. He is just a gutless mindless turd who got caught and wants people to feel sorry for him because he has spent 5 years in Gitmo Bay whilst the US had to adjust its court and legal proceedures to eventually charge this arsehole. The evidence being so great that Hicks would have been a gray beard before he saw the light again

Hicks went before US Military Judical Judge. He had to explain to the Court what he had done in Afghanstan with the Al Qaeda and Tahliban before Plea Bargin was to be excepted by the Court etc. He is expected to get 7 years jail minus time seved in Gitmo of 5 years and is expected back in Australia to serve remainder of sentance in an Australian Jail. He could be returned to Australia in 6 weeks. And serve less than 2 years jail in an Australian Prison. He has been also banned from talking to the Media for 12 months and can not profit from any books or media releases as a condition to his sentancing. It is believed that finalization of Hicks sentancing is to be ratified this weekend by the Military Tribunal in Gitmo. And he also had to agree to the fact he was not tortured or co-erced whilst in Gitmo at any stage and admit this in Court etc. You can guess the Free David Hicks nit wits will not believe any of this for **** sake

I really look forward to this arsehole being returned to Australia with a possible release date from an Australian Prison in less than 2 years. As far as I am concerned he has pleaded guilty and is guilty and has committed treason. I get tired of these bleeding hearts idiots who have no idea that we are in the midst of a bloody war on TERROR.
